Acceptable Use Policy
Effective date: June 30, 2026
This Acceptable Use Policy ("AUP") sets out what you may and may not do on Vidsmark. It is part of, and should be read with, our Terms of Service. Breaking these rules can result in listing removal, warnings, suspension, or permanent account termination — and, where appropriate, reporting to authorities.
1. Gaming items only
Vidsmark is a gaming-only marketplace. You may list video games, consoles, gaming accessories, arcade machines, and gaming-related collectibles. Non-gaming items are not allowed.
2. Prohibited items
You may not list, sell, or buy:
- Counterfeit, pirated, or bootleg media — including reproduction cartridges/discs, copied or burned games, and unauthorized reproductions sold without clear, lawful disclosure.
- Stolen goods or items you do not have the legal right to sell.
- Recalled or unsafe items, including hardware subject to a safety recall or modified in an unsafe way.
- Anything illegal to sell under Canadian federal, provincial, or local law, or restricted to buyers who do not meet legal age or licensing requirements (for example, age-restricted titles sold to minors).
- Items that infringe intellectual property or that you are not authorized to distribute.
3. Honest listings and collector grading
Listings must be accurate and not misleading. Collector grading must be honest. If you describe an item as CIB, loose, sealed, tested, a specific region (NTSC/PAL/NTSC-J), or a particular variant, that description must be true. Use real photos of the actual item, disclose damage and defects, and do not misrepresent condition or rarity.
4. Prohibited conduct
- Fraud and scams — including non-delivery, item-not-as-described schemes, and chargeback abuse.
- Circumventing escrow or fees — for example, using listings or messages to push buyers off-platform to avoid protection or fees on what would be a protected sale. (The free local lane is allowed; deliberately evading fees on protected sales is not.)
- Fake reviews, ratings, or accounts — including manipulating reputation, astroturfing, or operating multiple accounts to deceive.
- Shill bidding or fake offers.
- Harassment, hate speech, threats, or abuse toward other users or staff.
- Spam, phishing, malware, or attempts to harvest other users' data.
- Abusing or attacking the Service — scraping at scale, bypassing security, reverse-engineering, or interfering with its operation.
- Using the Service for any unlawful purpose, including money laundering.
5. Content standards
Content you post (listing text, photos, profile, messages, reviews) must be your own or properly licensed, accurate, and free of unlawful, infringing, or obscene material. We may remove content that violates this AUP.
6. Reporting violations
If you see a listing or user that breaks these rules, report it through the Service or email support@vidsmark.ca. Tell us what's wrong and include the listing or handle. We review reports and act where appropriate.
7. Enforcement
Depending on severity and history, violations may result in content removal, a warning, withheld payouts pending investigation, account suspension, or permanent termination. Serious or illegal conduct may be reported to law enforcement. Account termination is also governed by our Terms of Service.
8. Changes
We may update this AUP as the marketplace grows or as the law changes. Material changes will be communicated through the Service or by email.
