Privacy Policy

This Privacy Policy explains how ToolFluency ("Vidsmark", "we", "us"), located at Greater Sudbury, Ontario, Canada, collects, uses, discloses, and protects your personal information when you use the Vidsmark marketplace and website (the "Service"). We handle personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy law.
1. Who is responsible for your information
Vidsmark is the organization responsible for the personal information it collects through the Service. Our Privacy Officer can be reached at hello@vidsmark.ca.
2. What we collect
- Account information: email address, password (stored securely by our authentication provider), public handle, and any profile details you add. If you sign in with Google, we receive basic profile information from Google.
- Marketplace activity: your listings, collection data, saved/liked items, follows, messages, reviews, and order history.
- Transaction information: records of purchases, sales, fees, payouts, and Vidsmark Credit. Payment card and banking details are collected and processed by Stripe — Vidsmark does not store your full card numbers.
- Technical information: device, browser, IP address, and usage data collected to operate and secure the Service.
3. Why we collect it (purposes)
- To create and manage your account and public profile.
- To operate the marketplace — listings, escrow checkout, payouts, refunds, and disputes.
- To process payments and prevent fraud and abuse.
- To provide support and respond to your requests.
- To improve and secure the Service.
- To send transactional messages, and — with your consent — marketing messages (see Section 7).
- To comply with legal obligations.
4. Consent
By using the Service, you consent to the collection, use, and disclosure of your personal information as described here. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us — though withdrawing consent may mean we can no longer provide parts of the Service.
5. Service providers (processors)
We share personal information with trusted service providers who process it on our behalf, under contract and only for the purposes we specify:
- Stripe — payments, Stripe Connect payouts, and buy-now-pay-later (Affirm/Klarna). Subject to Stripe's privacy policy.
- Firebase (Google) — authentication and database/hosting for account, profile, collection, and order data. Subject to Google's privacy terms.
- Anthropic — our optional AI listing assistant. When you use it, the listing details and photos you submit are processed (in the United States) to draft titles, descriptions, and item details. Subject to Anthropic's privacy policy.
Some of these providers may process or store data outside Canada (for example, in the United States). Where that happens, your information may be subject to the laws of those jurisdictions, including lawful access by their authorities. We take reasonable steps to ensure providers protect your information.
Analytics. We use our own first-party, privacy-respecting analytics to understand how the site is used (for example, page views and how far people get through browsing, adding to cart, and checkout). We do not use third-party advertising trackers or advertising cookies, and we do not sell your data. These measurements use a temporary per-visit session identifier that is stored only for the length of your visit and is not linked to advertising profiles.
6. Other disclosures
We may disclose personal information when required by law, to enforce our Terms, to investigate fraud or safety risks, or in connection with a business transfer (such as a merger or acquisition). Your public handle and listing/seller information are visible to other users by design.
7. Marketing email and CASL
We comply with Canada's Anti-Spam Legislation (CASL). We send marketing emails only with your consent, every marketing message identifies us and includes a working unsubscribe link, and we honour unsubscribe requests promptly. Transactional messages (such as order, payout, and dispute notices) are not marketing and may still be sent.
8. Your rights
Under PIPEDA you have the right to:
- Access the personal information we hold about you;
- Correct information that is inaccurate or incomplete;
- Delete your personal information and account, subject to information we must retain by law (such as transaction records);
- Withdraw consent and unsubscribe from marketing.
To exercise any of these rights, contact hello@vidsmark.ca. We will respond within the timeframe required by law. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.
9. Retention
We keep personal information only as long as needed for the purposes above or as required by law. Transaction and tax records may be retained for the periods required by applicable regulations. When information is no longer needed, we securely delete or anonymize it.
10. Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit and access controls. No system is perfectly secure, but we work to protect your data and will notify affected users and regulators of a breach as required by law.
11. Children
The Service is not directed to children under the age of majority. We do not knowingly collect personal information from them. If you believe a minor has provided us information, contact us and we will delete it.
12. Changes to this policy
We may update this Privacy Policy. Material changes will be communicated through the Service or by email. The "Effective date" above shows when this version took effect.
