Seller Terms
Effective date: June 30, 2026
These Seller Terms apply when you list or sell on Vidsmark. They add to, and form part of, our Terms of Service, Acceptable Use Policy, and Refunds & Disputes Policy. If there is a conflict, the Terms of Service govern unless these Seller Terms say otherwise for a seller-specific topic.
1. Becoming a seller
Any eligible account can list. To receive payouts on protected sales, you must complete onboarding with our payments provider, Stripe (via Stripe Connect), and provide the identity and banking information Stripe requires. You are responsible for keeping that information accurate.
2. Your listings
- Listings must be for permitted gaming items only and follow the Acceptable Use Policy.
- Descriptions, condition, and collector grading must be honest and accurate (CIB, loose, sealed, tested, region, variant). Use real photos of the actual item and disclose all defects.
- You must have the legal right to sell the item and to set its price.
- You are the seller of record. The sale contract is between you and the buyer; Vidsmark is the marketplace, not the seller (except for items Vidsmark lists directly).
3. Fees
- Listing: free.
- Local cash/Interac e-Transfer pickup sales: free.
- Protected (escrow) sales: a seller fee of 8% of the item price (6% on the Pro plan, 5.5% on the Shop plan), deducted before payout, plus a $0.49 small-order fee on orders under $20. (The buyer's separate 2% protection fee is currently waived as a launch promotion.) Escrow checkout requires an item price of at least $8; cheaper items can be sold via free local pickup.
- Seller plans: selling is free on the Collector plan. Optional monthly subscriptions — Starter $5, Pro $10 (6% fee), Shop $15 (5.5% fee) — add a lower fee, a larger AI auto-fill allowance and extra seller features. Optional and cancellable; see seller plans.
Fees are shown before you confirm. We may change fees on a going-forward basis with notice. Amounts are in Canadian dollars unless stated otherwise.
4. How Vidsmark protects sellers
Escrow protects buyers, but it is built to be fair to sellers too. You should never lose an item to a buyer who simply changes their story. Here is how we protect you. Some of these mechanisms roll out through launch and beta.
4.1 No auto-refund on a bare claim
Escrow is not released back to a buyer just because they say "it didn't arrive" or "it's not as described." Disputes are evidence-based and time-bound, and Vidsmark mediates the outcome. The buyer's word is not final — both sides are asked for proof, and we decide what is fair before any money moves.
4.2 Proof of delivery or handoff
- Shipped orders: release is tied to carrier tracking / delivery confirmation. When tracking shows the item was delivered, you are protected against a buyer who claims it never came.
- Local pay-online (escrow) orders: the buyer inspects the item in person, then taps Confirm delivery to release escrow — do this at handoff, before you hand the item over. A buyer can't take the item in person and then falsely claim it never arrived.
4.3 If the buyer goes quiet
On a shipped order, if the buyer neither confirms nor opens a dispute within 48 hours after carrier-confirmed delivery, contact us from your order — carrier-confirmed delivery is strong evidence, and Vidsmark releases to you after an evidence review. (An automatic timed release is rolling out through launch and will remove even that step.) On a local pay-online deal, have the buyer confirm at handoff — funds release immediately when they do, so there is no waiting window. A silent or ghosting buyer cannot leave your payout hanging indefinitely.
4.4 Buyers are rated too
Vidsmark uses two-way ratings. Buyers build a reputation just like sellers do, so you can see who you are dealing with. Buyers who act in bad faith — false claims, no-shows, chargeback abuse — can be flagged, limited, or removed.
4.5 Buyer confirms condition and grade
On delivery, the buyer confirms the item matched the grade you listed (CIB, loose, sealed, tested). This "Description Accuracy" step protects honest sellers — disputes turn on an objective confirmation of what was received, not on a buyer's mood — while keeping grading accountable on both sides.
4.6 Chargebacks and serial bad-faith buyers
If a buyer bypasses our dispute process and files a card chargeback, Vidsmark works to protect you — we provide the tracking, handoff, and confirmation records to contest fraudulent chargebacks, within what card-network and payment rules allow. We also act against repeat bad-faith buyers who abuse refunds or chargebacks.
5. Escrow, fulfilment, and payout
5.1 How a protected sale works
When a buyer pays for a protected sale, Vidsmark holds the funds (via Stripe) — you are not paid yet. You must fulfil promptly: ship with tracking, or complete the agreed handoff, within the timeframe stated in the listing or our guidelines.
5.2 Release of funds
Your payout (item price minus the 8% seller fee) is released after the buyer confirms the item arrived as described (at handoff for local pay-online deals), or after Vidsmark's evidence-based review when a buyer goes silent on a tracking-confirmed delivery or a dispute is decided in your favour. Payouts are sent to your connected Stripe account and deposited to your bank on Stripe's payout schedule — typically a few business days; your first-ever payout can take a week or two.
5.3 Holds
We may delay or hold a payout where there is an open dispute, suspected fraud, a policy violation, or a verification issue, until the matter is resolved.
6. Local lane (not escrow-protected)
You may also sell locally for cash or Interac e-Transfer on pickup, free of charge. Local deals are not escrow-protected — Vidsmark does not hold those funds and cannot mediate or reverse them. You are responsible for your own safety and judgment when meeting buyers in person.
7. Refunds, disputes, and returns
As a seller you agree to our Refunds & Disputes Policy. Disputes are evidence-based, time-bound, and mediated by Vidsmark — a refund is not automatic just because a buyer asks for one. If an item is materially not as described, you may be required to accept a return and/or refund. Where you are at fault (wrong item, undisclosed damage, mis-grading, not working when sold as tested), you generally bear the return shipping cost and your seller fee will not apply to a fully refunded sale.
8. Vidsmark Credit
Any seller incentives paid as Vidsmark Credit (for example, referral or promotional credit) are closed-loop, non-cashable store credit — spendable only on Vidsmark and never withdrawable as cash. See the Terms of Service for full details.
9. Taxes
You are responsible for determining, collecting, and remitting any taxes (such as GST/HST) that apply to your sales, and for your own income-tax obligations. Vidsmark does not provide tax advice.
10. Your obligations and conduct
- Ship or hand off on time and communicate with buyers promptly and respectfully.
- Do not manipulate reviews or reputation, use multiple accounts to deceive, or steer protected sales off-platform to avoid fees.
- Maintain honest grading and accurate inventory.
11. Suspension and termination
We may remove listings, withhold payouts pending investigation, or suspend or terminate seller privileges for violations of these Seller Terms or our other policies, suspected fraud, or excessive disputes. Pending obligations to buyers survive termination.
12. Changes
We may update these Seller Terms. Material changes will be communicated through the Service or by email; continued selling after they take effect means you accept them.
